Introduction:

This website is operated by Domino CRM. Throughout the site, the terms “Domino CRM,” “we,” “us,” and “our” refer to Domino CRM, its subsidiaries, and affiliates (where applicable). Domino CRM offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site, using the Service, using any of our products and services, engaging in an electronic conversation powered by our products and services, and/or purchasing something from us, you engage in the “Service” and agree to be bound by the following terms and conditions (“Service Terms” or “Terms”).

The Service allows users to create and design chatbots using the online Domino CRM builder platform. We reserve the right to change or discontinue the provision of the Service at any time, temporarily or permanently, without prior notice.

2. Account:

To use the Service, you must register an account. You are responsible for maintaining the confidentiality of your account and password, as well as restricting access to your account. You agree to assume responsibility for all actions that occur under your account or password.

3. User Content:

The Service allows users to upload, post, and share content, including but not limited to text, images, and code (collectively referred to as “User Content”). You are solely responsible for the User Content you provide through the Service. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any liability in connection with User Content.

4. Ownership Rights:

The Service and its original content, features, and functionality are and will remain the exclusive property of Domino CRM and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and branding cannot be used in connection with any product or service without the prior written consent of Domino CRM.

5. Disclaimer of Warranty:

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will be uninterrupted or error-free. In particular, the Service may be temporarily unavailable for maintenance or other reasons.

6. Limitation of Liability:

Under no circumstances shall Domino CRM, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, data, use, business reputation, or other intangible losses arising from (i) your access or use or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

7. Indemnification:

You agree to defend, indemnify, and hold harmless Domino CRM, its affiliates, licensors, and service providers, as well as its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from any claims, liabilities, damages, judgments, costs, or expenses arising from your breach of these Service Terms or documents they incorporate by reference, or your violation of any law or the rights of a third party.
